In the name of God amen, I Daniel Neale of the county of Westmoreland and parish of Cople in Virginia, Gent. Being sick in body but whole in mind and of full & perfect memory, thanks & praise be unto almighty God, do make & ordain this my last will & testament in manner and form following.  That is           to say, first & foremost revoking all former wills & testaments by me made written or unwritten and this only to be taken deemed & esteemed to be my last will & testament in manner and form following.

First & principally, I commend my soul unto the hands of Almighty God, my maker & redeemer & blessed savior Jesus Christ in sure & certain hope it shall be reunited to my body at the general day and glorified and my body to be decently buried in the earth from whence it came at the discretion of my executrix hereafter named and for such worldly goods as it hath pleased God to bestow on me far beyond my desires I will & dispose of in manner & form following.

First & foremost, my will is that all my just debts be duly paid by my executrix.

Item.  I give & bequeath unto my daughter Hannah Neale one Negro girl called Molly to be delivered to her at the day of her marriage.

Item.  I give and bequeath unto my son Presly Neale one Negro girl called Betty to be delivered to him at the age of twenty-one years.

Item.  I give and bequeath unto my son Daniel Neale one Negro woman called black Hannah to be elivered to him at the age of twenty-one years.

Item.  I give and bequeath unto my son Christopher Neale one Negro girl called Nanny to be delivered to him when he attains to the age of twenty-one years.

Item.  My will & pleasure is that my two Negro men Jack & Dick remain & continue, that is to say the use & benefit of them to be wholly to my dear & loving wife Ursula Neale, and after her decease Negro Dick to descend to my son Rodham and Jack to my son Christopher.

Item.  I give & bequeath unto my daughter Frances Neale one Negro to be paid out of the increase of the before expressed Negro women if it should so happen that any of them brings children and if it so happens that none of the said Negro women brings children that live, then I give & bequeath to my said daughter Frances three thousand pounds of tobacco to be paid her in the lieu thereof and the second living child born of the aforesaid Negro women I give & bequeath unto my son Rodham Neale.

Item.  I give & bequeath unto my son Presly Neale all my land on which I now ive to him & his heirs forever, and all the remainder part of my estate to be equally divided , my loving wife & children all to have equal share thereof.

Item.  It is my desire that all my children stay & remain with their mother until they be of age or be married unless they go away by their motherís consent.

Item.  I appoint my dear & loving wife Ursula Neale to be my whole & sole executrix of this my last will & testament in witness whereof I have hereunto set my hand & fixed my seal this nineteenth day of December Anno Domini one thousand seven hundred & thirteen.

 Dear Listers,  I am very grateful for the generous help I've been receiving from some of you and I just want to share the text and sources concerning Hannah Neale and James Carter of Stafford VA with all of you:

[From the OLD CARTER PRAYERBOOK]printed in 1662: "James 8th son was Borne on Christmas Day 1684 it being Thursday at 2 in the morning & was Christened at Home on Sundy. Mr. Jno Edwards, Mr. Tho. Wilkes & Mrs. Edwards standing as God parents." also "Mrs. Hannah Carter departed the Life on 9th Octo. 1722 and left a sorriful husband and 4 tender children Tho. Danl Presly & Hannah."

 "James Carter married twice, first on Oct 3, 1715, to Hannah Neale, daughter of Daniel Neale;  she died Oct. 9, 1722, leaving children Thomas, Daniel, Presley and Hannah.  On Aug. 12, 1724, he married Mary, daughter of Hugh Brent of Lancaster County."  [Family History: Southern Genealogies #1, 1600s-1800s CD:  HISTORICAL SOUTHERN FAMILIES, Vol. XX, by Boddie, "Thomas Carter of Virginia, with Related Families Reno, Tipton, Skipwith, Dale" ..., Page 20]

"James Carter (son of Capt Thomas) married August 10, 1724, Mary Brent, daughter of Hugh Brent of Lancaster County [VA].  She was probably his second wife.  They removed to Stafford [VA] where they had the following children born: Joseph b. 1725; John b. May 7, 1727;  James b. March 31, 1729;  William (twin) b. January 11, 1731;  George (twin) b. January 11, 1731;  Catherine b. April 1, 1735;  Charles b. "James Carter, "an honest, good man" , died October 24, 1743.  [Obituary, Overwharton Register.] September 4, 1747, Joseph, John and George Carter, sons of James Carter had a deed for 1137 acres of land in which their father James Carter of Stafford dec'd is spoken of as a brother of Joseph Carter of Lancaster."  ABSTRACT OF WILL OF DANIEL NEALE:
"Neale, Daniel, gent., 19 December 1713; 2 March 1713. One negro to dau. Hannah Neale; sons Presley, Daniel, Christopher, and Rodham one negro each; wife Ursula one negro and she to be exx; dau. Frances Neale one negro; son Presley plantation where I live. Residue of estate to wife and children."  [WESTMORELAND COUNTY, VA WILLS, 1654-1800][COLONIAL FAMILIES, Volume IV, Neale Family 382-384.]

          So there is a will for James, but I haven't seen it yet :)
